Declaration and Agreement to be listed on the Data Base of the Independent Constituency of the LSSA

I understand that the LSSA is a constituency based organization

I understand that the LSSA is a constituency based organization and that if I am a member of the Black Lawyers Association ("BLA") or the National Association of Democratic Lawyers ("NADEL"), I would be represented on the LSSA govenance structures by such constituent;

I accept that the Independent Association of Legal Practitioners in South Africa ("IALPSA") is a co-ordinating structure for those members of the profession not already represented by the BLA and that I cannot be a member of IALPSA and of those organizations at the same time.

I accordingly declare and certify (by clicking the button below) that I am not a member of BLA or of NADEL and I undertake that if I do become such a member, to declare such fact and unsubscribe as member of IALPSA.

I understand that I am not discouraged to join any of the constituents of the LSSA. This declaration is only a tool to ensure that the representation of independent attorneys on the LSSA remains independent in the context as used in the 2021 constitution of the LSSA.

I undertake to keep documentation and information supplied to me by the Independent Constituent (or put differently, IALPSA) confidential. Such documentation is supplied to inform debate and the formulation of the Independents' Position on relevant issues.

Declaration of Independent Members serving on Committees (example Independent HoC or EXCO members of the LSSA) and Discussion or Decision Making Bodies of the Independent Constituent of the Law Society of South Africa:

In particular, I Confirm that I understand and accept that

The Independent Constituent promotes, supports and strives for

  • Non-political/non-alliance with a specific political party
  • The ultimate introduction of the one practitioner one vote principle in determining the representation of lawyers in South Africa
  • The creation of local independent associations which lead to federal execution
  • Upholding, protect & advance human rights, civil liberties & Rule of Law for all citizens
  • broad based participation in economy on an equal footing for all citizens based on qualification, competency & experience
  • A non-racial, non-sexist judicial system based on competency & experience

Without limitation to its aims & objectives, the Independent Constituent

  • strives to do all necessary for advancement & protection of its interests and image while recognizing the rights of the public
  • Promotes, protects & upholds the rights & interests of all members [old & young] recognizing the public interest
  • Co-operates with organisations with similar objectives for benefit of members
  • Opposes & challenges all discriminatory practices against any citizen
  • Supports, empowers & protects all women, children & the elderly
  • Is a provincial, national & international voice for its members
  • Supports, empowers & protects all disadvantaged communites
  • Promotes & advances the enhancement of jurisprudential order based on & reflective of cultural aspirations, norms & value of each society
  • Members are not members of BLA or Nadel and do not support the views of such organizations that are contrary to the Independent views.

I confirm that I am independent as set out in the constitution of the Law Society of South Africa which define members of its Independent Constituent as being Non-BLA and Non- NADEL. I confirm that I am not a member of the BLA or NADEL, nor am I a loyal supporter of one or both of those organisations that has resigned such organisation/s with the purpose of influencing the Independent Constituency to the benefit of those organisations. I undertake not to compromise the Independence of the Independent Constituent but understand that I may agree with their viewpoint as a result of independently applying my mind. I agree that my details may be added to a data base for purposes of the Independent Constituency communication and related matters.
